SpaceX sues Texas AG, Grimes County to block Terafab records release
SpaceX sued Texas's AG and Grimes County to keep sealed the tax-incentive and cost records behind its $119 billion Terafab chip plant.

what happened
SpaceX filed suit Sept. 8 in Travis County's 126th Civil District Court against Texas Attorney General Ken Paxton and Grimes County, seeking to block release of public records on its Terafab semiconductor project, after Paxton's office ruled July 28 that most of the records should be released under the Texas Public Information Act, per Spectrum Local News and ENR. Two Grimes County residents had requested records on the project's tax-abatement application, land-acquisition costs, negotiation correspondence and structural-design details; SpaceX argues release would expose trade secrets and cause competitive harm. ENR reported Terafab's filed buildout figures across four phases: $16.8 billion (2026-28), $38.6 billion (2029-31), $38.6 billion (2032-34) and $25.3 billion (2035-36), for a total of $119 billion. A newly formed group, Grimes County Citizens for Responsible Development, led by director Marie Egyed and represented by attorney Bill Aleshire, filed its own petition Oct. 27 in Travis County's 126th District Court seeking a writ of mandamus against Grimes County to compel release of the same records, including emails between county officials, consultants and SpaceX, SpaceX's tax-abatement application, and correspondence documenting the Chapter 381 Economic Development Agreement; Aleshire said "it is precisely when a project is as controversial and of such broad public interest as SpaceX/TeraFab that we need more transparency, not less," per ABC13 Houston and KBTX.
why it matters
The suit tests how much of a tax-incentive deal a company can keep sealed even after the state's own attorney general has ruled for disclosure, a question other local governments weighing nine-figure incentive packages for SpaceX, Tesla and peers will watch. For Grimes County and similar jurisdictions, the outcome will shape how much visibility residents and watchdog groups get into incentive terms while a project like Terafab is being built out.
